A New Castle City Board of Adjustment Continuance Hearing
took place on December 6, 2005 at 8:10 p.m. in the City of
New Castle’s Town Hall.

Gerard Kavanaugh, City Solicitor
Jeff Bergstrom, Building Official
David DiMeglio, Applicant
Mayor Klingmeyer called the meeting to order at 8:10 p.m.
This hearing is a continuation (third meeting) regarding 739
Center Street. Mayor Klingmeyer read the Notice of Public
Hearing that states, “An application has been filed
(2nd continuance) by David DiMeglio, P. O. Box 4063, Delaware
City, DE 19706 for property located at 739 Center Street,
New Castle, Delaware, Parcel Number 21-1700-032. The above
property owner is requesting the following variances: a rear
yard setback from 25 ft. to 9 ft., footprint from 50% to 89%,
front setback from 20 ft. to 0 ft., family square foot from
1,750 to existing (610 ft.2), no off street parking requirement,
lot size from 3500 ft.2 to existing (800 ft.2), lot width
from 30 ft. to existing (14 ft.), lot depth from 100 ft. to
existing (60 ft.). For the purpose of considering this application,
the Board of Adjustment will continue a public hearing on
Tuesday, December 6th, at
7:30 p.m. in Old Town Hall located at 201 Delaware Street,
Second Floor, New Castle, Delaware.”
Mayor Klingmeyer asked Mr. Bergstrom to provide background.
Mr. DiMeglio applied for a permit to remove and replace an
addition at the rear of his property. The Board of Adjustment
considered his application and suggested that he return with
additional information to help them make a decision based
on the scale of the buildings in the immediate neighborhood.
Mr. Kavanaugh expressed concern with what Mr. DiMeglio requested
versus what he is presenting tonight. (Extensive discussion
took place between Board members and the applicant about what
his plans consist of.)
The materials Mr. DiMeglio presented for Board consideration
was not to their satisfaction. Plans presented do not correspond
with one another. Mr. Kavanaugh made a motion that the matter
be continued to give Mr. DiMeglio the opportunity to present
to this Board with plans as required by Section 230-57(d)(2a)
by April 1, 2006. Mr. Athey seconded the motion which passed
unanimously.
The hearing was adjourned at 9:30 p.m.
